Florida’s ‘Free Kill Law’-- When Doctors Get a Get-Out-of-JAIL-Free Card (But Your Parents Don’t)

Imagine you’re in the Sunshine State and you find yourself needing a simple surgery, whether it be for an injury or even cosmetic, when suddenly your doctor’s mistake turns fatal—and Florida law hands the medical miscreant a free pass. 

Welcome to Florida’s infamous “Free Kill Law” (Fla. Stat. 768.21(8)), where only the spouse, children under 25, or the victim themselves can sue for a medical malpractice–related death. 

Everyone else? Tough luck—no wrongful-death claim for you.

Who’s Left Holding the Bag?

  • Adult kids over 25: Sorry, Mom’s your savior, but you can’t sue the surgeon who botched her biopsy.

  • Parents of deceased adults: Lost your child to a misread test? Your grief doesn’t count under this statute.

  • Spouses with adult-only marriages: No minor children, no claim—nice knowin’ ya.

A Drunk Driver vs. a Drunk Scalpel

Here’s the mind-bender: if a drunk driver kills your 30-year-old parent, you can sue—no age cap. 

But if a doctor’s misdiagnosis turns your parent terminal, you can’t. 

Florida’s law treats negligent mechanics and drunk drivers with more sympathy than negligent MDs.

History’s Verdict: Supreme Smiles

In 2000 the Florida Supreme Court said “no repeal,” citing the state’s obsession with low medical costs. 

Since when did “keep doctor bills down" become more important than justice for grieving families”?!


The Repeal on the Horizon

Good news! 

The legislature just passed a bill to repeal the Free Kill Law, headed to Gov. DeSantis’s desk for a July 1, 2025 signature. 

Cue the medical-community freakout about sky-high malpractice premiums and fewer doctors moving south for the winter!

Why It’s Ridiculous

  • Arbitrary Ageism: Because losing your 26-year-old adult kid is apparently less tragic than losing your 24-year-old.

  • Medical Immunity: Doctors can dodge accountability if their patient’s kids are “too mature.”

  • Insurance Handcuffs: Caps keep premiums low, but at what moral cost?

So, Florida: ready to swap the Free Kill Law for the Fair Kill Law? 

Let’s give every grieving family the right to sue—because the only free pass in healthcare should be for your parking ticket, not a death sentence!!
